Terms of service

1. Overview
Cactus Cloud Media LLC ("we," "our," or "the Company") provides professional drone videography and media production services, primarily for real estate and local businesses in New Mexico. By using our services or website, you agree to the following Terms of Service.

 
2. Services
We offer:
• Aerial real estate photography and video
• FPV interior flythroughs
• Commercial property showcases
• Custom-edited promotional media

Delivery timelines vary by project and will be confirmed in writing.

 
3. Client Responsibilities
Clients must:
• Ensure accurate access and instructions are provided
• Obtain necessary permissions for filming
• Notify us of airspace, HOA, or neighbor restrictions in advance

We may reschedule or cancel any shoot due to safety concerns or access issues.

 
4. Payment Terms
• Payment is due upon receipt unless otherwise stated
• A 50% deposit may be required for larger projects
• Late payments may incur a 5% monthly fee

We accept major credit cards, ACH, and select payment apps.

 
5. Cancellations & Rescheduling
• Cancel at least 48 hours in advance to avoid fees
• Cancellations within 24–48 hours: 25% fee
• Less than 24 hours or no-shows: full service charge applies

Weather-related reschedules are accommodated at no charge.

 
6. Ownership & Licensing
All footage remains the intellectual property of Cactus Cloud Media LLC. Clients receive a royalty-free license to use delivered media for promotional purposes. Redistribution, resale, or sublicensing is prohibited without written approval.

 
7. Restrictions on Use
Clients agree not to:
• Misrepresent or misuse the media
• Claim authorship of content
• Request unsafe or illegal drone flights

 
8. Liability
We are not liable for:
• Delays due to weather, airspace, or technical issues
• Indirect or consequential damages from media use

We carry general and drone-specific liability insurance.

 
9. FAA Compliance
All flights are conducted in compliance with FAA Part 107 regulations by certified operators. We follow all required protocols for safety and airspace authorization.

 
10. Privacy
Client data and footage are handled with care and not shared without consent. For more, see our Privacy Policy.

 
11. Governing Law
These terms are governed by the laws of New Mexico. Disputes will be resolved in Bernalillo County courts.

 
12. Updates
Terms may be updated without notice. The latest version will always be available at cactuscloudmedia.com.
